Please read these Terms and Conditions ("Terms") carefully before using the EveryPath mobile application ("App", "Service") operated by EveryPath ("us", "we", or "our").

1. Acceptance of Terms

By downloading, installing, or using the EveryPath app, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

EveryPath is a personal bucket list companion application that allows users to:

  • Create and organize life goals and aspirations
  • Plan goals with milestones, timelines, and budgets
  • Track progress and completion
  • Create memory scrapbooks for completed goals
  • Sync data across devices using iCloud
  • Share and collaborate on goals with friends and family (optional)
  • Use AI-assisted planning tools (optional)

3. User Responsibilities

3.1 Eligible Use

To use EveryPath, you must:

  • Be at least 4 years of age (or have parental consent if under 13)
  • Have a valid Apple ID
  • Have an iOS device running iOS 17 or later
  • Have an active internet connection for iCloud sync features

3.2 Your Content

You are solely responsible for:

  • All content you create, upload, or share within the App
  • Ensuring your content complies with applicable laws
  • Ensuring you have rights to any photos, videos, or text you upload
  • Maintaining backups of important data

3.3 Account Security

You are responsible for maintaining the security of your Apple ID and iCloud account. We are not liable for unauthorized access to your account due to your actions or negligence.

4. Account & Access

4.1 iCloud Requirement

Many features of EveryPath require an active iCloud account. Data synchronization, collaboration, and backup features depend on Apple's iCloud service.

4.2 Service Availability

We strive to provide continuous access to the App, but we cannot guarantee uninterrupted service. The App may be temporarily unavailable due to:

  • Maintenance and updates
  • Technical difficulties
  • Issues with Apple's iCloud service
  • Forces beyond our control

5. Content Ownership

5.1 Your Content

You retain all rights to the content you create within EveryPath. This includes:

  • Your goals, plans, and milestones
  • Photos and videos you upload
  • Journal entries and memories

5.2 License to Us

By using the App, you grant us a limited license to:

  • Store your content in iCloud on your behalf
  • Display your content to you and anyone you choose to share with
  • Process your content to provide App functionality (e.g., AI planning)

This license ends when you delete content or stop using the App.

5.3 App Ownership

EveryPath, including all intellectual property rights, remains our exclusive property. This includes:

  • The App's design, code, and functionality
  • EveryPath branding, logos, and trademarks
  • Curated goal suggestions in the Discovery feature

6. Prohibited Uses

You may NOT use EveryPath to:

  • Violate any laws or regulations
  • Infringe on others' intellectual property rights
  • Upload harmful, offensive, or illegal content
  • Attempt to reverse engineer, decompile, or hack the App
  • Scrape or extract data from the App using automated tools
  • Impersonate others or misrepresent your identity
  • Use the App for commercial purposes without our permission
  • Share inappropriate content with minors

7. Termination

7.1 By You

You may stop using the App at any time by deleting it from your device. To remove your data from iCloud, manage it through iOS Settings > iCloud.

7.2 By Us

We reserve the right to suspend or terminate your access to the App if you:

  • Violate these Terms
  • Use the App in ways that harm us or other users
  • Engage in fraudulent or illegal activity

8. Disclaimers

8.1 "As Is" Service

EveryPath is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Accuracy, reliability, or completeness of content
  • Freedom from viruses or harmful components

8.2 AI Assistant Disclaimer

AI-generated goal plans are suggestions only and may not be accurate, complete, or suitable for your specific situation. You are solely responsible for decisions made based on AI recommendations.

8.3 iCloud Dependency

Data synchronization depends on Apple's iCloud service. We are not responsible for data loss, sync failures, or issues caused by iCloud service disruptions.

9. Limitation of Liability

To the fullest extent permitted by law:

9.1 No Liability for Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or content
  • Loss of profits or revenue
  • Loss of opportunity
  • Cost of substitute services

9.2 Maximum Liability

Our total liability to you for any claims arising from your use of EveryPath shall not exceed the amount you paid for the App (if applicable) or $100, whichever is greater.

9.3 Your Responsibility

You are responsible for maintaining backups of important data. We recommend regularly exporting or backing up content you cannot afford to lose.

10. Changes to Terms

We may modify these Terms from time to time. When we make changes:

  • We will update the "Last Updated" date
  • For significant changes, we may notify you through the App or email
  • Your continued use of the App constitutes acceptance of the revised Terms
  • If you don't agree to the changes, stop using the App

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of EveryPath shall be resolved through binding arbitration, except where prohibited by law.
